  1. About these terms

1.1 The terms and conditions of sale of Pepita t, hereinafter “Terms of sale”, include the rights and obligations of the seller, Pepita t, and you, the buyer, in any case in which you place an order for the products of the Online store Pepita t (hereinafter online store).

1.2 The Online sales terms applied together with the privacy policy and the return policy which are detailed in the web page are referred as “Legal Terms”.

1.3 Please read carefully the legal terms before buying any goods and / or services online and print or download a copy for future purchases. The legal terms may be changed at any time. Any legal term that has been revised will be applied to all new orders from the moment of its publication on the website. By placing an order for the products, it will be implied that you have agreed on the current legal terms.

  1. About you

3.1 The terms “You” and “Yours” for the Online sale, refer to the user of the online store and the buyer who ordered the products in the online store.

3.2 In order to buy our products: (1) you must be 18 years old or older, (2) you need an active email and a phone where you can be easily contacted, (3) you need to pay for the products in advance using a credit card registered to your name or a bank transfer, and (4) the information you provided for your registered account with us must be complete, accurate and correct.

3.3 If you are not aware of all the conditions established in point 3.2, you must refrain from placing orders in the virtual store. If we suspect that any of the conditions are not met, we reserve the right to refuse acceptance or delivery of your order.

3.4 It is your responsibility to ensure that your login and password data are kept safe at all times.

  1. About our online store, goods and services

4.1 The online store is intended for sales only to the end user. Some dispositions described in this document will only apply to you under the applicable laws of consumers who are considered a “Consumer” for the purpose of your planned purchase on the Webstore. These dispositions will be clearly mentioned in the online sales terms that apply only to consumers. For the purposes of these Online sales terms, “Consumer” means a natural person who is acting for purposes that are predominantly outside of his or her business, trade or profession.

4.2 All products that can be purchased from our online store are subject to availability and we may not be able to supply your order. We reserve the right to withdraw any product from the sale at any time and our sole responsibility to you for withdrawing any of them will be the refund of the payment if they are not available for delivery.

5.1 All prices shown in the online store:

  • Are payable in the currency shown.
  • They include the value added tax (VAT) at the applicable rate.
  • They refer to individual items.

5.2 We try to ensure that all prices shown in our online store are correct; however errors may occur. If we discover an error in the price of a product that you have ordered, we will inform you as soon as reasonably possible. In such circumstance we will give you the option to either confirm your order with the correct price or cancel it. If you decide to cancel the order after having informed you of the error in the price and you have already paid for it, a full refund will be done as soon as reasonably possible.

  1. How to buy goods and services

6.1 When you access the online store you can navigate freely through our product catalog without registering by using one of the search criteria and you can compare several products that you have selected by clicking on the [Compare] button. If you need more information about the characteristics of these, click on “details”.

6.2 In order to buy products, you’ll need to be registered first. If you have purchased in previous occasions, you can register with your account number and password by clicking on the button [My account]. If you have forgotten your password or you have not previously purchased in our online store before, please follow the instructions to register a customer account. Your newly created account and password will be promptly provided via e-mail.

6.3 After choosing your products, type the amount you wish to buy and proceed to the next step by clicking on the [Cart] button. At this point your order is not yet completed. In the next step, the total price (VAT included) for the items is displayed, as well as extra charges for services and other products that are automatically included with the ordered goods (such as transportation, personalization if chosen …). In this stage you can continue buying by clicking on the button [Continue shopping] or modify your choice by going back to the previous step, or completing the final steps of your order by clicking on the [Start purchase] button. In the next step you need to create an account or if you already have it, register by entering your e-mail and password.

  1. Receipt of your order

7.1 The order you have ordered to us constitutes an offer to purchase our products. Following the processing of your order, we will send you a notification, automatically generated by e-mail, with the receipt of the order. The receipt contains the elements of your order, specifying the type, quantity and price of the products that you have selected.

  1. Your payment

In the next step of the order process, we will ask you to finalize your payment. You can pay by bank transfer. For security reasons, your payment must be made within a limited time starting from the processing of your order. If your payment is not processed within this time, you will receive an online notification that your payment transaction has not been completed and your order has been canceled.

  1. Your order confirmation

9.1 After we have received the confirmation that your payment has been accepted we will send you by e-mail an order form automatically generated by e-mail and our receipt. We send the receipt only in electronic format. The order confirmation contains details of the products and services you have ordered, the total cost of the order and the order number. We advise you to keep a copy of the order confirmation and the Online sales conditions. You will need to review these details in case you need to contact us regarding your order.

9.2 Please note that your order confirmation is simply an acknowledgment that your order has been received by us: that does not mean that we have accepted your request.

  1. Cancellations of orders

10.1 No order should become a legally binding contract until the products are delivered.

10.2 Orders can be cancelled

  • For you or for us, if the goods are no longer manufactured or temporarily unavailable.
  • For you or for us, when there is an error in the price of the ordered products shown in the online store.
  • For us, when your payment authorization is cancelled later on.
  • For us or for you, if the order does not comply with the” conditions of sale Online”.
  • For us, when we suspect that your order is not real, fraudulent or involves identity theft, bank or credit cards or payment information.
  • For you, when we are not able to deliver the products within 30 days after placing the order.

10.3 If the order is canceled by our decision, we will refund you within 14 calendar days for the payment we received from you.

  1. Legal guarantee for compliance goods

11.1 If you notice that within two (2) years from the date of delivery, that at the time of the delivery the goods were defective in materials or otherwise not in accordance with the order, subject to certain conditions, as a consumer you benefit from a legal guarantee that entitles you without any cost to repair or replace the items, or also if the repair or replacement in our opinion are impossible or disproportionate, you will be refunded or reduced the price paid for the products. In order to correctly claim your guarantee, you must contact us within 2 months from the date you noticed the defect or non-conformance. We are not obliged to offer you any remedy for wear or scratches caused by normal use, or if the product claimed has failed or suffered any damage caused by improper use, lack of maintenance or other external impacts.

11.2 Our guarantees stated in point 11 may not affect the rights that the consumer has, derived from the statutory law.

  1. Commercial guarantee.

In the case and to the extent that the products benefit from a manufacturer’s guarantee above the legal guarantee, we must extend the manufacturer’s warranty within the conditions that have been set by the manufacturer.

  1.  Our responsibility

13.1 We have made an effort and taken care to upload images of the products, descriptions, specifications and other information in our online store, which serve as a guide and illustration only, without any guarantee or representation, free of error and suitability for any case particular. We cannot be held responsible for your trust in the information provided in our online store.

13.2 We will not be responsible to you for any special, indirect or consequential damages, any economic loss, loss of income, benefits, anticipated savings or business opportunity for any damage to your reputation or any loss that is not reasonably attributed by us, arising of or in connection with your order and our product supply.

13.3 Notwithstanding the foregoing, our total responsibility to you for products delivered under the terms of online sale must not exceed the price you have paid for them.

13.4 The limitations of our responsibility contained herein should not affect the rights derived as a consumer from the statutory law.

  1. Force majeure

    Neither we nor you will be held responsible for any delay or failure to comply with the terms of sale online if the delay or failure arises from any circumstance which is outside our respective control. Such events may include (but are not limited to) fires, floods, earthquakes, storms, natural disasters, wars, riots, acts of terrorism or malicious damage or destruction of our facilities, equipment or assets.

  2. Current law and dispute resolution

16.1 The legal terms are under the Spanish laws, excluding the application of the convention of the United Nations on contracts for the international sale of goods.

16.2 Without prejudice to the statutory right to make disputes for the resolution in the courts of your place of residence when you are a consumer, you and we must bring the litigation in accordance with the legal terms for the resolution of the exclusive jurisdiction of the Spanish courts.

  1. Miscellaneous dispositions

17.1 Our responsibility, relaxation or delay in the exercise of any of your rights under the legal terms to constitute a waiver of such rights will not be considered.

17.2 The non-validity or unenforceability of any provision of the online sales terms will not have any effect on the validity or enforceability of other provisions.

17.3 You may not assign, transfer or delegate your rights and obligations under the terms of online sales to any third party without our prior written consent. You must not assign, transfer or delegate your rights and obligations under the terms of sale.

17.4 We will have the right to assign, transfer or delegate or sub-contract any of our rights and obligations under the terms of online sales at our discretion. It is understood that any of our assignments, transfers, delegations or sub contracts will not affect in any way to the rights that derive under these online sales terms.
